◆ Commission ProcessSlots are granted through contacting us through SNS or through email.Clients with model art ready, have the option of paying the quoted price up front, in 2 installments- half of the quoted amount at the start of the commission, and the other half at any point in the commission before the final delivery, or through a discussed payment plan.Clients must pay 50% of the total amount to guarantee a commission slot. Any and all processing and transfer fees will be covered by the client that will be included in the invoice sent by hortus representative.Payments are to be made through PayPal invoice.Commission updates will be sent through Discord or other SNS, and may come in the form of pictures, or screenshots.The commission is completed once the final model PSD has been sent to the client, and has been approved, or if the client has not given any feedback 48 hours after delivery.Minor revisions after the sketch and process are free of charge, but there is a certain threshold for the amount of minor revisions that can be made before fees will be incurred.◆ Terms of Use
Hortus prohibits commissioner to use the art pieces for NFT or be fed to AI programs.If such activity were to be seen we will take action let the whole Art community know and shall be black listed by hortus.

◆ How long will the commission take?The commissions will be delivered within the time frame of the order o depending on the current workload of the team/ Should the client need the commission completed and delivered within a specific deadline, please let us know in advance, and do note that this will incur an additional charge.◆ Refund Policy
Please note that all sales are final and no refunds will be issued unless the client’s commission has been terminated . A 50% refund will be issued, and all related art documents (sketches, PSDs, etc.) will be sent to the client should HORTUS decide to cancel the commission. If the Client wishes to avail a commission again, they will need to pay the full price.◆Revisions, Updates, and FeedbackThe client is encouraged to give feedback during the design and sketch process in order for the model to be up to standard.◆ Revisions

◆ Major Revisionsthe following are considered major revisions and will incur additional fees if availed.◇Change of model’s clothes◇Additional animation assets/frames or Re-doing the entire Expression Assets◇Additional expression assets than the ones originally discussed

◇Change of more than 10% of the model’s layers
◇Revising already done parts with the exception of small preferences, and mistakes the artist may have made.◆ Client’s Role & Etiquette
The client is expected to check for any mistakes in the model art that the artist may not have seen. These include unclean layers, wrong colors, and any general mistakes that are detrimental to the art’s quality.
The client should try to the best of their abilities to provide feedback within 48 hours of receiving an update from the artist. This is to save time and ensure that all efforts are meaningful.
Please do not micromanage the artist.Negative Feedback that is not allowed.◆ Micromanaging
Forcing the artist to copy another art style/ draw in another style different from their own
Wanting to be particular but requesting a revision without a clear idea, proper references, and direction.Being too fickle about changes (ie- requesting for multiple changes to the same part, thus making the artist undo them multiple times)

◆If the client refuses to be civil, becomes excessively nit-picky, or requests too many things beyond the skill of the artist, the artist reserves the right to terminate the commission, and issue a refund. This will result in being added to a blacklist, which is also shared by many artists and riggers in the community.

The final delivered product CANNOT UNDER ANY CIRCUMSTANCES be used to make a non-fungible token (NFT)

◆ Artist Rights
The artist has the right to use the work for their portfolio, promotion of commissions, and posting of WIPs. Prohibiting the artist from streaming and/or posting anything about the commission will incur a fee that is decided on how private the commission will be. The fee is there to make up for lost marketing and inquiries.◆ The Client must NOT under any circumstances claim my work as their own.The client has full commercial rights and is entitled to use the model for live streaming, social media graphics, and other activities that are of a similar nature.
Should the client wish to resell the model, permissions from both the artist and rigger MUST be obtained, and the model must be resold without any modifications made to it. The new owner must also comply and sign / agree to the artist, and rigger’s terms of service.

The artist may modify the model in any way when providing model updates for a client. The updates may include changes in texture, clothing changes, facial feature updates, and hair changes.
The artist is allowed to reuse textures that are common to all models, such as glasses, background effects, accessories, facial parts, etc.
The artist is NOT allowed to reuse textures that are custom drawn specifically for a client.
The artist is NOT allowed to modify and resell an already completed model commission, unless they have illustrated and designed the model for a different client who has violated the Terms of Service, and has had their commission forfeited, in that case, the artist may modify the model in order to make it fit for reselling.

◆ You are responsible for any troubles that occur due to Vtuber activities using models created from the delivered illustrations.◆ Any problems caused by Vtuber activities using models created with the delivered illustrations will be at your own risk.◆ Artist has nothing to do with Vtubers who are active with models created from illustrations delivered.
